Becirovic on the Constitutional Court’s Decision: A new legal Victory for the State of BiH

The decision of the Constitutional Court of BiH confirmed that the entities have no jurisdiction to challenge and question the final judgments of the Court of BiH, as well as the acts of state institutions, said Denis Bećirović, a member of the Presidency of BiH, regarding the decision of the Constitutional Court of BiH to annul part of the conclusions of the National Assembly of Republika Srpska.

Bećirović assessed that the decision of the Constitutional Court of BiH represents a major legal victory for the state of Bosnia and Herzegovina, and that it is an encouraging message for all citizens in our state that the institutions have the strength to protect the constitutional order of Bosnia and Herzegovina.

He emphasized that this decision of the Constitutional Court of BiH sent a strong message.

“The Entities do not have the right to self-determination, nor are they allowed self-organization and territorial secession, which threaten the constitutional order and territorial integrity of the state of Bosnia and Herzegovina. The Constitutional Court of BiH, with its decision in case no. U-26/25, once again confirmed that independent judicial institutions act in accordance with the Constitution and laws of Bosnia and Herzegovina, and that the rule of law has the strength to oppose attempts to derogate from the constitutional order by the entity authorities in the RS entity,” Bećirević’s statement stated.

He emphasizes that in the explanation of the Decision, the Constitutional Court of BiH clearly emphasized that, based on the principles of the rule of law and the principle of separation of powers, final and binding decisions of the institutions of Bosnia and Herzegovina must be implemented, and not reviewed by lower authorities.

“Any refusal to implement these decisions represents a direct violation of the Constitution and laws of Bosnia and Herzegovina and has serious legal consequences. The authorities in the RS entity must be aware that any further challenge to the authority of the highest state institutions leads not only to new judicial processes, but also to further destabilization of the state and a threat to peace and security,” Bećirović emphasized.

Let us recall that the Constitutional Court of BiH, after a two-day session, annulled part of the conclusions of the RS National Assembly, which related to the adoption of the text of the resolution on the self-determination of the RS, as well as the statement that the Court of BiH issued a verdict based on the decision, as stated in the conclusion, of an unelected foreigner, Christian Schmidt.
