Member of the Presidency of Bosnia and Herzegovina, Denis Bećirović, announced that he will file an appeal before the Constitutional Court of Bosnia and Herzegovina if the National Assembly of the Republika Srpska adopts an unconstitutional law on immovable property.
He made such a decision after the National Assembly of Republika Srpska again put on the agenda of today’s session a Proposal of the law on immovable property used for functioning of public authority, and it is the same legal act that the Constitutional Court of Bosnia and Herzegovina declared unconstitutional on September 22.
At that time, the Constitutional Court emphasized in its decision that the Republika Srpska does not have the constitutional authority to regulate the legal matter that is the subject of the law on immovable property that is used for functioning of public authority because this issue is within the jurisdiction of the state of Bosnia and Herzegovina.
As Bećirović states in the press release, according to available information from the field, immovable property that is being unconstitutionally tried to be reorganized by the unconstitutional laws of the BiH entity of Republika Srpska, in some units of local self-government is unconstitutionally and illegally registered in favor of entity institutions, local self-government units, public companies and public institutions founded by this entity.
Given that this is a repeated attempt to adopt the same unconstitutional law, Bećirović called on the entity’s National Assembly to reject the Bill on immovable property used for the functioning of public authority as unconstitutional and without a legal basis for its adoption.
“If the National Assembly of the Republika Srpska adopts the proposal of this unconstitutional law, I call on the competent institutions and law enforcement agencies to act in accordance with their competencies,” added Bećirović.
And finally, he called on the Office of the High Representative in Bosnia and Herzegovina (OHR) to, within the framework of its jurisdiction, in the specific case, take measures to ensure the implementation of the decisions of the Constitutional Court of Bosnia and Herzegovina, as well as to prevent continuous violations of the Constitution of Bosnia and Herzegovina.
