First Decision of the RS Tax Administration: Penalty due to the Origin of the Property

The Tax Administration of the Republika Srpska has issued the first decision to a natural person who, during a tax audit, failed to prove the origin of his assets, and was ordered to pay 345,237 BAM to the Budget of the Republika Srpska, based on a special property tax.

This is stated in a statement by the Tax Administration of the Republika Srpska, which adds that in this first decision, the tax base was determined to be 460,316 BAM, to which a special tax rate of 75 percent was applied, because based on the analysis performed, a significant disparity was determined between the reported income and the actual value of the assets.

“The taxpayer was allowed to submit documentation and other evidence to confirm the origin of the assets. However, the evidence submitted was not sufficient to determine the origin of the assets, which is why a decision was issued on the payment of a special property tax.

The taxpayer has the right to appeal the aforementioned decision within the specified period, which, in accordance with the law, postpones the execution of the decision,” the statement reads.

It is emphasized that this is the result of the systematic collection, processing and analysis of data on property and income of all citizens of the Republika Srpska, which the Tax Administration, within the Sector for Determining the Origin of Property and Special Property Tax, has been carrying out since the entry into force of the Law on Determining the Origin of Property and Special Property Tax.
