First-Instance Verdict Delivered: “Karton revolucija” Activists Receive Judicial Warning

The court did not find that the accused acted within the framework of nature and environmental protection, because, as stated in the verdict, the behavior in question cannot be justified by willfully damaging another’s property.

Activists from the “Karton revolucija (the Cardboard Revolution)” movement, Adi Selman and Nedim Musić, were accused of damaging another’s property – specifically, cutting two plastic hoses that supplied water to illegally constructed facilities during an activist action at Prokoško Lake. They received the most lenient judicial sentence.

They were issued a judicial warning.

“The court considers that conducting a criminal procedure in these circumstances, which was closely followed by the public through mass media and social media, and issuing a judicial warning, represents a sufficient measure of social condemnation regarding the specific behavior in the indictment. The issued judicial measure and warning to the accused will achieve both general and special prevention,” stated Judge Almina Hadžić-Iširlija of the General Court in Kiseljak in the statement ofreasons.

The court did not find that the accused acted within the framework of nature and environmental protection because, as stated in the verdict, the behavior in question cannot be justified by willfully damaging another’s property.

Selman and Musić announced that they would continue their efforts to protect the nature monument Prokoško Lake from willful and illegal construction and the devastation of this area.

“The point is that we have restored hope to the people, hope that injustice can be overcome. This means our next step is to destroy illegal structures on Prokoško Lake, which should be demolished. We are going to fight against the Cantonal Prosecutor’s Office of the Central Bosnia Canton, which refuses to sanction an obvious crime on Prokoško Lake,” Selman said after the verdict was issued.

“We are even more motivated after this court proceeding. Until the people who should stand before the prosecutor and the court appear, we will not stop. The people who have facilities on Prokoško Lake should have been standing here today, but instead, we who are trying to protect the lake are here. Until the opposite happens, we will not stop,” Musić announced.

A representative of the Prosecutor’s Office did not attend the delivery of the verdict. The amount of damage has not been determined, as it was not specified in the indictment. The damage was repaired with adhesive tape.

The defense for Selman and Musić announced an appeal, even though the most lenient sentence was handed down.

As a reminder, they used an ax to cut two plastic hoses that diverted water from the spring to about 300 illegally constructed structures in this legally protected natural area. Meanwhile, the Karton revolucija movement filed a criminal report with the Central Bosnia Canton Prosecutor’s Office regarding illegal construction on Prokoško Lake and the destruction of nature, Zurnal.info writes.
