Milorad Dodik confirmed that the land in Jahorina was sold for slightly more than 41 million convertible marks. It is about 56 dulums of land near the ski center of Jahorina, which, despite the earlier decisions of the Office of the High Representative (OHR) and the Constitutional Court of BIH, was sold to the company “Drvo Export” from Teslić.
“There is no OHR, their jurisdiction does not exist. It’s all an attempt to give importance to oneself. They are under no obligation and we will not honor it. They can do whatever they want, they will not be respected. The BiH Attorney’s Office does not exist according to the Constitution,” said Dodik.
In its commentary, the OHR reminded that the Law on the Temporary Prohibition of the Disposal of State Property explicitly prohibits any sale or other form of disposal of state property, that is, any act on the disposal of such property is null and void. They transferred the responsibility to the Prosecutor’s Office of Bosnia and Herzegovina. In the meantime, the Office of the Attorney General has filed a case, sent a letter warning the Ministry of Trade and Tourism of the RS, which responded “to act in accordance with the Constitution of the RS and its competences.”
In the office of the High Representative, they also stated that they have repeatedly warned potential investors and buyers of state property, which is under a ban on disposal, of possible negative legal consequences, but the sale has been completed.
Milorad Dodik answers everything, “I will send brandy to Schmidt to make a toast, the project will not be stopped.”
“Jahorina is today a place of large investments. After “Belgrade on the water”, Jahorina is the largest investment construction site in the Balkans, there is no bigger one. And of course that needs to stop. It won’t stop. The money has been paid,” said Dodik.
But this is neither the first nor the last case of illegal sale of state property. A few days ago, the decision to sell 486 square meters of land in Jahorina to Milorad Erić was published in the official newspaper, where the RS was mentioned as the owner of the property rights. The Ministry of Trade and Tourism is responsible for the sale. The President of the Constitutional Court of Bosnia and Herzegovina, Valerija Galić, could not talk about specific cases, but she recalled several decisions made by this institution.
“They state that Bosnia and Herzegovina has exclusive jurisdiction in the regulation of state property,” she said.
And here again, the state was not asked.
Muharem Cero, an expert on state property, warns that with the decision to sell state land, Acting Director of the Official Gazette of the RS, Miloš Lukić, repeated the criminal offense of non-implementation of the decisions of the High Representative in Bosnia and Herzegovina, for which he is being tried at the Court of Bosnia and Herzegovina.
“The same criminal offense was committed by the Prime Minister of the RS, Radovan Višković, after he signed a decision contrary to the Law on the Temporary Prohibition of Disposing of State Property imposed by the OHR. There is also the Minister of Trade and Tourism, Denis Šulić. The prosecutor’s office has all the elements to start the case,” adds Cero.
By the way, behind the company “Drvo-export” from Teslić, there is SNDS official Srđan Klječanin Rufi, whose name has been associated with dubious capital in recent years. Nebojša Vukanović, the leader of the List for Justice, warned about this on several occasions.
“He is legal for Jahorina, he previously opened a mine without any permits. We have information that Zvonko Veselinović, a businessman from Serbia, connected to the Serbian authorities, is behind the purchase of the land in Jahorina and the mine. This is part of Dodik’s agreement with the dark powers”, says Vukanović.
Let us remind you that Srđan Klječanin, apart from being Dodik’s confidant, is associated with coal mining in Bistrica near Prijedor, where coal was mined for months before the company received an official permit for exploitation, despite blockades and protests from the local population. And of course, despite the decisions of the Constitutional Court of Bosnia and Herzegovina and the decisions of the OHR, which also cover mines, Akta writes.
