The eighteenth special session of the National Assembly of Republika Srpska is underway in Banja Luka, where laws on the prohibition of the activities of ‘extra-constitutional’ institutions in Bosnia and Herzegovina are being discussed.

The first item on the agenda is the Draft Law on the Non-Application of Laws and the Prohibition of the Activities of ‘extra-constitutional’ Institutions of BiH under an Urgent Procedure, and this law is being explained by the Minister of Administration and Local Self-Government of the RS, Senka Jujić.
The remaining three laws will be proposed jointly, namely the laws on the High Judicial and Prosecutorial Council of the RS, on the Amendment to the Criminal Code of the RS, and on the Special Registry and Transparency of the Work of Non-Profit Organizations, under an urgent procedure.
Vice President of the RS National Assembly Ana Ljubojević stated that the vote on the proposed laws will take place immediately after the debate is over.
The RS Government proposed these laws immediately after yesterday’s verdict against the President of the RS, Milorad Dodik, before the Court of BiH.
The head of the Alliance of Independent Social Democrats Club in the RS National Assembly, Srđan Mazalica, stated today that the verdict against RS President Milorad Dodik “attacked the constitutional order that will be protected by the adoption of a law on the non-application of laws and the prohibition of the activities of extra-constitutional institutions of BiH.”
He said this during a debate on the proposed Law on the Non-Application of Laws and the Prohibition of the Activities of ‘Extra-Constitutional’ Institutions of BiH.
Mazalica stated that Republika Srpska has been practically brought to the wall, “because due to such activities of BiH institutions, there is no other choice but what Srpska is currently doing.”
– Any failure to execute Schmidt’s order leads to a possible court verdict and this is dangerous for every citizen in BiH. That is why, with the Law on the Non-Application of Laws and the Prohibition of the Activities of Extra-Constitutional Institutions of BiH, we are not only defending Milorad Dodik, but the constitutional and legal order of BiH, claims Mazalica.
He claims that everything in the proposed law is in accordance with the Constitution.
However, the head of the SDS parliamentary group, Ognjen Bodiroga, claims that the proposed laws for today’s session represent “a blow to the Constitution and the Dayton Peace Agreement.”
– If you want to return the competencies, you have to return them the way you transferred them. And it is precisely these competencies that were transferred by the SNSD, said Bodiroga.
He reminded that the laws on the Prosecutor’s Office and the Court of BiH “were imposed by the High Representative, and verified by the SNSD with its coalition partners in the Parliamentary Assembly of BiH”.
– Now return them as well. Tell your coalition partners nicely what you want and then vote, added Bodiroga.
He said that the SDS will not participate in “this adventurism”.
A similar opinion is held by the PDP Club, represented by Mirnja Savić Banjac, who believes that decisions are being made hastily and impulsively.
The draft law on the non-application of laws and the prohibition of the activities of ‘extra-constitutional’ institutions of BiH in an urgent procedure was explained by Senka Jujić, Minister of Administration and Local Self-Government of the RS.
She said that the proposed law stipulates that the laws on the Court of BiH, the Prosecutor’s Office of BiH, the Investigation and Protection Agency of BiH and the High Judicial and Prosecutorial Council of BiH will not be applied or enforced on the territory of the RS.
– According to the Constitution of BiH, all government functions and powers that are not explicitly entrusted to the institutions of BiH by the Constitution of BiH belong to the entities, stated Jujić.
As she said, each member of the Presidency of BiH has, by virtue of their function, civilian command over the Armed Forces, and “no entity will threaten or use force against another entity, and under no circumstances will the armed forces of one entity enter the territory of another entity or reside there without the consent of the government of the other entity and the Presidency of BiH”.
The Prime Minister of the Republika Srpska, Radovan Višković, said that the leadership of this BiH entity had ‘appealed and talked too much’, and that an official letter was sent today to the President and Prime Minister of the Federation of BiH for discussion and agreement.
“I say in advance that they will not respond. “Live and see,” said Višković at a special session of the National Assembly.
“The Serbian conscience should stand behind what the National Assembly is doing today,” said Višković, adding that everyone has the right to their own opinion, but they should also present it to the end.
“This issue is important for our people who are being persecuted and tried,” said Višković.
19:45 – Deputy Prime Minister of the RS Government Miloš Bukejlović said that ‘The Draft Law on Amendments to the Criminal Code of the Republika Srpska stipulates that disrespect for the decisions of institutions and bodies of the Republika Srpska in the institutions of BiH or local self-government units will be punishable by imprisonment for six months to five years.’
“A security measure is imposed for the aforementioned act – a ban on performing a profession, activity or duty,” emphasized Bukejlović, who is also the Minister of Justice of the Republika Srpska.

“If we had the opportunity as a parliamentary group, and we did not because it is a special session, we would have requested the withdrawal of all these items from the agenda. It is clear to you that we will not support any of these laws,” said the Vice President of the RS National Assembly.

He said that ‘the Court and the Prosecutor’s Office of BiH want to make criminals out of Serbs’. He stressed that ‘the adoption of new laws does not mean secession’. “Next week we will go with a new set of laws,” he said.
Dodik said that the situation is extremely favorable to ‘restore the subjectivity of Republika Srpska’. “Today we are defending the international agreement in BiH,” Dodik said. Dodik stressed that Republika Srpska does not want any war or conflict.
He indicated that he was an actor in two important, as he stated, violent attempts to change the Constitution of BiH, one of which was the “Prud process” and the other the “Butmir process.” “Then we introduced the possibility of playing into the political game and we played great, both processes failed,” Dodik emphasized.
