The member of the BiH Presidency, Denis Bećirović, said that the state property of Bosnia and Herzegovina belongs to the state and that any attempt at unconstitutional and illegal action by the lower levels of government will be addressed decisively and promptly.
“Only the state of Bosnia and Herzegovina has the exclusive competence to regulate all issues related to state property through the decisions of competent state bodies. Entities, as well as lower levels of government, must respect these decisions. According to the provisions of the Constitution of Bosnia and Herzegovina, the state of Bosnia and Herzegovina continued the international legal subjectivity of the Republic of Bosnia and Herzegovina. It is the titleholder of state property,” said Bećirović.
Bećirović said that the state of Bosnia and Herzegovina possesses not only external but also internal continuity of the (Socialist) Republic of Bosnia and Herzegovina, which functionally represents state power, it was announced.
“The term ‘state’ in the Constitution of BiH refers exclusively to Bosnia and Herzegovina. More precisely, it refers to three different elements: to the overall state of Bosnia and Herzegovina as an independent, sovereign and internationally recognized entity, to the highest level of government in the state (in contrast to the entity and lower levels of government), and the sovereign international legal successor of the (Socialist) Republic of Bosnia and Herzegovina,” he said.
Bećirović tells the entity officials from the RS that they should know that the general principles of international law are an integral part of the legal order of the state of Bosnia and Herzegovina and the entities and that Bosnia and Herzegovina is obliged to respect the ratified Agreement on Succession Issues of the Former Socialist Federal Republic of Yugoslavia.
