The swift action taken by the Constitutional Court of Bosnia and Herzegovina highlights the ability of the legal system of Bosnia and Herzegovina to protect the sovereignty, constitutional order and stability of Bosnia and Herzegovina and to uphold the rule of law, the Office of the High Representative (OHR) said after the Constitutional Court, in response to recently adopted laws and acts in the National Assembly of Republika Srpska, issued interim measures that put them out of force, as well as all acts adopted for the purpose of their implementation.
In addition, the OHR said, the court prohibited all authorities in Republika Srpska and state officials of RS from acting on the basis of these laws and acts.
“This decision of the Constitutional Court of BiH ensures respect for the constitutional framework of the country and confirms the authority of state institutions,” the OHR stressed.
In a press release, they stated that the decisions of the Constitutional Court are clear: all state institutions, including the State Investigation and Protection Agency (SIPA), must continue to operate within the legal framework of BiH within their mandates and competencies. The integrity and functionality of these institutions are of fundamental importance for maintaining the stability and security of Bosnia and Herzegovina.
“All authorities and political actors in Bosnia and Herzegovina must respect the binding decisions of the Constitutional Court of Bosnia and Herzegovina, which are directly based on the General Framework Agreement for Peace,” the OHR stressed.
