One Month Custody ordered to Old Town Mayor and Associates

The Cantonal Court in Sarajevo ordered a one-month detention for Ibrahim Hadžibajrić and Alma Destanović. As Azra Bavčić, the spokeswoman of the Canton Sarajevo Prosecutor’s Office, announced, the court also issued a Decision on the blocking of funds and the temporary suspension of transactions – Ibrahim Hadžibajrić 217,000 BAM and 5,270 euros, and Alma Destanović 161,000 BAM.

Suspect Hadžibajrić was proposed to be detained due to the risk that he could influence witnesses, cover up evidence, and repeat the criminal offense while at large, while Alma Destanović was proposed to be detained due to the risk of escape and the risk that she could repeat the criminal offense if she was released.

Meda and Rajevos agreed and carried out business on behalf of Beg – it sounds like a fable. In fact, it is the decrypted encrypted communication of the Sky application, attached as one of the evidence of the KS Prosecutor’s Office. Meda, better known as Elmedin Karišik, got two parking spaces, on Trg Austrije and near the House of Armed Forces, and gave 80 percent of that business to Ibrahim Hadžibajrić, known in the Sky world as Beg. For the defense, the Sky application is disputed because it represents a violation of privacy. Admittedly, we have not heard when one’s privacy ends and criminal acts begin, but we have heard that for the defense, renting out a parking space is not disputed.

“The fact is that the Municipality was authorized to rent that space and that it was authorized and obliged to charge rent. All this was done in accordance with the law. It is foreseen that it will be possible to conclude the contract without a public invitation”, said Asim Crnalić, Ibrahim Hadžibajrić’s lawyer.

Another controversial parking lot is the Vijećnica parking lot, in Telali Street. The municipality of Stari Grad, as the holder of the right of disposal, gave that land, based on the agreement, to the KJKP Tržnice pijaca Sarajevo for use, and in accordance with the legal powers, they concluded a sublease agreement with TC Baščaršija for five years, from 2018 to 2023. After two years of subletting, the Municipality terminates the contract with Tržnica and consequently they cancel the contract with TC Baščaršija, which initiates a lawsuit and is represented by Ifet Feraget and Edin Šabanović.

“We filed a lawsuit in the court at the beginning of 2020 to cancel that illegal termination of the contract between Tržnica and Baščaršija and, as far as I can remember, on Independence Day, March 1, 2021, with the illegal assistance of the Stari Grad Police Station, TC Baščaršija was illegally evicted and third parties entered the possession of that parking lot,” said lawyer Feraget.

And those third parties, we will learn from the presentation of prosecutor Darko Soldat, are Adnan Maglić and Admir Arnautović, known as Šmrk, who visited the director of TC Baščaršija in the disputed parking lot and, with exceptional power of persuasion, succeeded in their intention to evict the company TC Baščaršija from the property, said the prosecutor. And it is the meeting place of the interests of Hadžibajrić and Šmrk. This is evidenced by the intercepted conversations of the Sky application, as well as the existence of witnesses.

“I wouldn’t comment on that, I don’t remember that particular example,” said Crnalić.

Among other things, Hadžibajrić is accused of having received a bribe of 150,000 marks, paid to him by F.H., who a few months before the payment bought a construction plot in the territory of Stari Grad municipality, at a tender. From the words of the defense, we learn that the buyer of that construction plot is Hadžibajrić’s first cousin, and that the money he is paying him is, in fact, a loan. And that’s where the knot of the family tree began to unravel, so we also learned from the Prosecutor’s Office that Hadžibajrić’s brother-in-law is the director of the Tax Administration. There are so many family ties that the likelihood of this being a coincidence is slim. But there is nothing controversial for the defense lawyer either.

Marsela Bajramović, Alma Destanović’s lawyer, mostly agreed with lawyer Crnalić, and that the scope of what her client is charged with is incomparably smaller – she says, only two contracts that she signed with the authority of the chief. Destanović is a citizen of BiH and Serbia and possesses both passports, and due to the fact that she was born in Kosovo, she also possesses their identity cards. These are just some of the evidence and reasons why the Prosecutor’s Office requested custody, because they could influence the witnesses, which, according to the prosecutors, Darko Soldat and Samir Selimović, Ibrahim Hadžibajrić already tried to do. Given the contacts and persistence in committing criminal acts, there is a possibility of hiding evidence, but also the danger of escape, the prosecutors pointed out.

For four others who were arrested as part of the same police operation and whose case is pending before the Court of Bosnia and Herzegovina, a one-month detention was ordered. Among them are Seid Hadžibajrić, Elmedin Karišik and others.
