The Council of Ministers of BiH supported the Payment of RS Debt following Viaduct’s Lawsuit

Following the extraordinary session of the Council of Ministers of Bosnia and Herzegovina, it was decided that an extraordinary session of the Fiscal Council of Bosnia and Herzegovina should be scheduled to fulfill the obligations under the arbitration award in the case of Viaduct d.o.o. Portorož and others against Bosnia and Herzegovina, regarding the profit of the Central Bank of Bosnia and Herzegovina.

The Ministry of Finance and Treasury should now amend the Framework Budget Document for the period 2025-2027, and the Presidency of Bosnia and Herzegovina is authorized to submit the budget to the Parliamentary Assembly of Bosnia and Herzegovina, which will ultimately adopt it.

By settling the multi-million obligation, which is the result of the plaintiff’s dispute with the Government of Republika Srpska, the Council of Ministers of Bosnia and Herzegovina wants to stop the further calculation of interest, which amounts to 9,000 euros on a daily basis, and enable the smooth functioning of the BiH Air Navigation Services Agency (BHANSA), but also to stop other procedures that threaten the property of the Central Bank of Bosnia and Herzegovina and the budget funds of BiH institutions.

We would like to remind you that the Slovenian company ‘Viaduct and others’ initiated arbitration proceedings due to the unilateral termination of the concession contract of the Government of Republika Srpska for the construction of a hydropower system on the Vrbas River. The Government of Republika Srpska, by concluding an Agreement with the Council of Ministers of BiH on mutual rights and obligations in connection with the arbitration proceedings in the case of the Slovenian company ‘Viaduct’ d.o.o. Portorož and others against the respondent Bosnia and Herzegovina in 2017, undertook to unconditionally fulfill all its payment obligations under the judgment rendered in these arbitration proceedings on behalf of Bosnia and Herzegovina, upon receipt of a documented request from the Ombudsman of BiH.
