A Significant Increase in Pensions will be enabled in FBiH

Delegates of the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina (FBiH) yesterday adopted amendments to the Law on Pension and Disability Insurance, which brings more favorable conditions for extraordinary harmonization of pensions in the Federation.

Regarding the adoption of the Law on Amendments to the Law on Pension and Disability Insurance of FBiH at yesterday’s session of the House of Peoples of the Parliament of the FBiH, the Federal Ministry of Labor and Social Policy said that the law will enter into force after publication in the Official Gazette of the FBiH, given that the House of Representatives of the FBiH Parliament adopted this law in the same content in December last year.

”The aim of this law is to eliminate the observed ambiguities, more precisely define and improve certain provisions, harmonize the law with other regulations and international standards, implement two judgments of the Constitutional Court of the FBiH and the Constitutional Court of BiH, and take additional care to protect pensioners’ standards,” said Federal Minister of Labor and Social Policy Vesko Drljaca after the adoption.

He also explained that the provisions on regular and extraordinary adjustment of pensions are especially important for our pensioners. Namely, in the future, pensions will be adjusted according to the growth rate of nominal instead of real gross domestic product, which will practically mean a significant increase in pensions, which was agreed at the meeting with the representatives of pensioners.

The Ministry points out that the right of widows of killed soldiers and martyrs, who did not have the status of insured persons, to exercise the right to a survivor’s pension has been determined, considering that in the sense of this law, an injury at work is also considered an injury of a person that was obtained in the preparations and defense of BiH (in the period from September 18th, 1991 to December 23rd, 1995).

In addition to the spouse (widow or widower), the family members of the deceased insured are also considered to be extramarital partners, in accordance with the FBiH Family Law. This will enable this category of persons to realize the right to a survivor’s pension for the first time.

Also, in accordance with the Agreement on Mutual Rights and Obligations concluded between insurance carriers in the entities of BiH, the cumulative amount of proportional pensions earned in the entities cannot be paid in the amount less than the minimum pension, the Federal Ministry of Labor and Social Policy stated.
