Bradara requested a Review of the Constitutionality of the Law on Southern Interconnection of the FBiH

The President of the Federation of Bosnia and Herzegovina, Lidija Bradara (HDZ), has submitted a request to the Constitutional Court of the Federation of Bosnia and Herzegovina for the review of the constitutionality of the Law on the Southern Interconnection of the FBiH.

The explanation of the request states that this Law was adopted by the House of Representatives of the FBiH Parliament on December 12, 2024 and the House of Peoples of the FBiH Parliament on January 16, 2025, and that it was published in the “Official Gazette of the FBiH”.

“I submit the request for the review of the constitutionality of the aforementioned Law in its entirety due to the violation of the provision of Article IV.A.3.11.(1) of the Constitution of the Federation of Bosnia and Herzegovina, which reads:

‘(1) Each House shall adopt its own rules of procedure by majority vote and elect from among its members a Chairperson and two Vice-Chairpersons, who may not be from the same constituent people or from the ranks of others.’

Given that the rules of procedure of each house, according to the aforementioned article of the Constitution of the Federation of Bosnia and Herzegovina, represent a ‘constitutional category’, then the violation of the basic provisions of the rules of procedure of the houses of the Parliament of the Federation of Bosnia and Herzegovina ultimately results in the violation of the Constitution of the Federation of Bosnia and Herzegovina itself,” Bradara stated.

Bradara believes that the Constitution of the Federation of Bosnia and Herzegovina was violated during the vote, that is, she is delaying the adoption by urgent procedure without explaining the urgent urgency.

She also warns that the Rules of Procedure of the House of Peoples of the Federation of Bosnia and Herzegovina were violated, because the Government of the Federation of Bosnia and Herzegovina did not give an opinion on it.

The law was adopted at the beginning of this year, but since then no further activities have been carried out on the implementation of this project.
