Contract between the Trnovo Municipality and the company “Buroj Property Development” was signed on October 15, 2015 at a public ceremony in the City Hall. However, although it has been announced that this is the largest post-war investment in B&H, the contract between the Arab investors and the BH authorities is not available to the public.
Trnovo Municipality refused to deliver to the media the integral text of the contract, justifying that action with the fact that it is a contract between “two business partners”. Furthermore, Trnovo Municipality noted that a “very well-attended press conference” was held on October 15, 2015, which had the aim to provide the media with all relevant information regarding the Buroj Ozone Project, including all relevant details of the contract.
“At the day of signing of the Contract on implementation of this grand project, the Contract was signed in Bosnian and English language, as it was the case while signing the Protocol on cooperation (in late February this year). Considering that the Contract stipulates exclusively mutual relations, obligations and rights of two business partners (the Municipality and Buroj), and that both signatories decide on eventual publication of the entire contents of the Contract signed on October 15, 2015, Trnovo Municipality as one of the contract parties does not have jurisdiction to arbitrarily distribute all details of the Contract to the general public. As one of the signatories of the Contract, we are obliged to respect the right of our foreign partner to assess parts of the Contract as business secret and, as such, keep them out of the insight of the general public,” announced the Trnovo Municipality.
Moreover, the Municipality noted that each business contract, especially business contracts with foreign partners, have the same or even more rigorous treatment, and kindly ask for the mentioned arguments to be acknowledged.
“Especially having in mind that this is a project founded on entirely new and, for the Balkans, unknown standards among which is also the one that the foreign investor and local community are business partners who jointly, each to one’s own extent, both invest and make profit, and that for the first time in such kind of investment the local community did not give up on its own land registry property, in accordance with the Law on Property Rights the investor will be granted the right to construct for 99 years under the specified price of lease,” it was announced from the Trnovo Municipality.
