The Council for the protection of vital interests within the Constitutional Court of the Republika Srpska (RS), has accepted the request of the Bosniak Caucus in the Council of Peoples of RS for finding a violation of the vital national interest of constituent Bosniak people regarding the decision of the National Assembly of the RS to hold a referendum that refers to the Day of RS.
For the Council is also acceptable the request of the Bosniak Club in relation to the Law on processing and publication of the results of the census of population, households and apartments in 2013, for which the National Assembly of RS voted at the meeting that was held on the 13th of July this year.
The Council of the Constitutional Court of the RS determined that all procedural requirements for meritory deciding on these requests and its decision shall be adopted in the next 30 days, as confirmed after the session where two requests of the Club of Bosniaks were considered.
The subject of the discussion and decision of the Council were, therefore, questions of admissibility of those claims, more precisely the existence of conditions for meritory discussion and decision making on issues whether any of the vital national interests of the Bosniak people was violated with the disputed acts of the National Assembly of the RS.
Bosniak politicians emphasize that the 9th of January cannot be accepted as the Day of RS, and believe that they should implement the decision of Constitutional Court of BiH from the 26th of November 2015 by which the provisions of the Law on Holidays of RS, relating to the 9th of January as the Day of the RS, is unconstitutional.
They have announced that they will, regardless of the decision of the Council of the Constitutional Court of RS, continue the legal battle to challenge the decision about the entity referendum on the Constitutional Court of BiH if needed.
