Court of BiH confirmed Indictment confirmed in the case of Atif Dudakovic et al.

On 24 October 2018, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Atif Dudaković, Ekrem Dedić, Sanel Šabić, Ibrahim Šiljdedić, Safet Salihagić, Adis Zjakić, Hasan Ružnić, Redžep Zlojić, Samir Solaković, Fatmir Muratović, Muharem Alešević, Husein Balagić, Ale Hodžić, Edin Domazet, Ejub Koženjić, Ibrahim Nadarević and Said Mujić with the criminal offense of Crimes against Humanity under Article 172(1)h), as read with Subparagraph a), all in conjunction with Article 180(1) of the Criminal Code of Bosnia and Herzegovina, and the accused Atif Dudaković himself with the criminal offense of Crimes against Humanity under Article 172(1), Subparagraphs h) and a), as read with Article 183(1), and the criminal offense of War Crimes against Civilians under Article 173(1)c), all in conjunction with Article 180(1) of the Criminal Code of Bosnia and Herzegovina.

The indictment alleges that the accused, during the war and armed conflict in Bosnia and Herzegovina between the Army Republika Srpska and the Army of BiH, in the framework of a widespread and systematic attack launched by the 5th Corps of the Army of BiH, together with the attached units of the 7th Corps of the Army of BiH and R BiH police units that were subordinated to the 5th Corps of the Army of BiH, which lasted from 13 September 1995 to mid-November 1995, aimed against the Serb civilian population living in the territory of Bosanski Petrovac, Ključ, Bosanska Krupa and Sanski Most municipalities, knowing of the attack and that their actions constituted part of the attack, as members of those forces, knowingly and willingly took part in the joint criminal enterprise with a common purpose and design to permanently remove from the territory of those municipalities the entire Serb population that lived there, by persecuting them on ethnic and religious grounds (common criminal design), so in order to realize the goal they committed multiple killings of Serb civilians who lived there, destruction of their movable and immovable property unjustified by any military necessity, destruction and demolition of Orthodox Christian monasteries, churches and temples.
