The Panel of the Appellate Division of the Court of Bosnia and Herzegovina ruled that the Accused Enver Buza was guilty of the criminal offense of War Crimes against Civilians and sentenced him to 8 (eight) years in prison.
The accused Enver Buza is guilty of acting contrary to the rules of international humanitarian law during the war in BiH, during the armed conflict between the BiH Army on the one hand and the Croatian National Defense (HVO) on the other, and as a superior failing to take necessary and reasonable measures.
The first instance verdict was 12 years Buza’s trial was resumed after the Appellate Chamber quashed the first-instance verdict by which Buza, as acting Commander of the Prozor Battalion was sentenced to 12 years in prison and found guilty of a crime in Uzdol, where 27 Croatian civilians were killed on September 14, 1993, failing to punish his subordinates.
Prosecutor Sanja Jukic said that the first-instance verdict was revoked in order to remove the suspicion that the crime in Uzdol was committed only by members of the Prozor Battalion or other units over which the accused could also have control.
According to her, the testimony of the witnesses shows that two to three civilian police officers were in the action, but that they were not seen where the crimes were committed. She added that one of the witnesses said that Buza also ordered civilian police officers.
