Former Member of Army of Bosnia and Herzegovina sentenced for War Crimes against Civilian Population

On 19 June 2020, the Court of Bosnia and Herzegovina has repealed the Decision, No. S1 1 K 018560 15 Kro of 16 May 2017, by which the accused Adem Kostjerevac was ordered into custody on the custody grounds set forth in Article 132(1) a) of the CPC BiH.

The motion filed by the Prosecutor’s Office of BiH to order the accused into custody has been accepted. Thus, the accused was ordered into custody on the grounds set forth in Article 132(1) a) and b) of the CPC BiH, which can last no longer than 2 (two) years after the accused’s deprivation of liberty, that is, until 19 June 2022, or a new decision of the Court.

The Indictment of the Prosecutor’s Office of BiH, No. T20 0 KTRZ 0004193 09 of 8 April 2015, confirmed on 14 April 2015, charged the accused Adem Kosterjevac with the commission of the criminal offense of War Crimes against Civilian Population under Article 142 of the Criminal Code of the Socialist Federative Republic of Yugoslavia (CC SFRY), because during the war and the armed conflict in Bosnia and Herzegovina, as a member of the Military Police and the Muslim Brigade Zvornik of the Army BiH, during the period between 18 September 1992 and 4 October 1992, in the territory of the Municipality of Zvornik, he had acted in contravention of the rules of international humanitarian law by violating Article 3(1) a)  and  c), and Article 27 of the Geneva Convention relative to the Protection of Civilians in Time of War of 12 August 1949, and forced a non-Serb civilian woman into sexual intercourse.
