Defense of Hague indictee Ratko Mladic asked for the temporary suspension of the proceedings until the panel reaches a final decision on the issue of appeal, including appeals that may follow, or voluntary withdrawal or disqualification of Judge Carmel Agius and appointment of an impartial and independent judge.
In the explanation of the appeal was stated that the judge Agius violated Mladic’s right to a fair trial and the presumption of innocence.
Otherwise, the defense will request the annulment of the trial on the grounds of violations of the right to a fair trial.
The ICTY Appeals Chamber will decide on the appeal of Mladic’s defense.
Mladic’s defense lawyers argue that the right to a fair trial was violated, because he was not allowed to make full use of the right for presentation of the defense case, as reported by Srna.
