Ministers did not consider the Draft Law on Courts of BiH

At today’s session, the Council of Ministers of Bosnia and Herzegovina, although it was foreseen in the proposed agenda, did not consider the Draft Law on the Courts of Bosnia and Herzegovina, proposed by the Ministry of Justice of Bosnia and Herzegovina.

BiH Minister of Foreign Trade and Economic Relations and Deputy Chairman of the BiH Council of Ministers, Staša Košarac, told reporters after the session that he insisted at the session of the Council of Ministers that the item on the agenda – the Law on Courts – be withdrawn.

“We appreciate that a completely different wording is acceptable, that is the law on the court. We want to say completely transparently that from the domain of acts that we need to adopt from the domain of the judiciary, we cannot consider, and that the law on the court is harmonized, and you know it is not, in any other act if we do not have a law on the Constitutional Court of BiH prepared at the same time,” said Kosarac.

For us, he added, the law on the Constitutional Court of Bosnia and Herzegovina is a priority.

“We are bound by the attitudes of the institutions of the Republika Srpska. We are fully committed to the implementation of the conclusions of the National Assembly. In this context, we see absolutely no need to partially, from the aspect of the judiciary and the need to pass certain laws arising from 14 priorities, first discuss the law on the court, while the working group has not yet submitted the draft law on the Constitutional Court of BiH,” said Košarac.

I believe, he stated, that the working group for the judiciary, which in the meantime has completed the amendment with credible members from the constitutional and legal sphere, will deliver the new text, i.e. the new text of the law on the Constitutional Court, to the Council of Ministers in the next 15-20 days.

“Given the fact that the Constitutional Court does not have its own law, we appreciate that this is significantly important, referring to the departure of foreign judges from the Constitutional Court of Bosnia and Herzegovina,” stated Košarac, Fena reports.
