RS National Assembly Accuses BiH Court of “Coup d’État” in Newly Adopted Conclusions

The National Assembly of Republika Srpska adopted tonight the “Information on the Subversion of the Constitution of BiH – Measures and Tasks to Preserve the Constitution of BiH” and concluded that the fact that “the Court of BiH committed an act of coup d’état and the complete collapse of the constitutional order of BiH because it issued a verdict based on the decision”, as they stated, of “an unelected foreigner Kristijan Šmit”, and not on the basis of a law adopted by the Parliamentary Assembly of BiH.

The National Assembly rejects and does not accept any decision by Christian Schmidt, it is written in the conclusions regarding the information on the subversion of the Constitution of BiH – measures and tasks to preserve the Constitution of BiH, proposed by the SNSD, NPS-DNS, DEMOS-SPS, SP and US parliamentary groups.

The National Assembly of Republika Srpska considers all laws and decisions of bodies that are not defined by the Constitution of BiH, primarily the High Judicial and Prosecutorial Council, the Prosecutor’s Office of BiH, the Court of BiH and the Investigation and Protection Agency of BiH, to be null and void, the conclusions state.

The National Assembly of the Republika Srpska states that the decision of the Court of BiH to rule on the basis of a decision imposed by an individual is contrary to the Constitution of BiH and that by doing so, the Court of BiH “has destroyed the constitutional order of BiH”.

The Parliament requests the Attorney General’s Office of the Republika Srpska to file criminal charges against all prosecutors of the Prosecutor’s Office of BiH and judges of the Court of BiH who acted on the imposed decision, for organizing, planning and preparing criminal offenses against the constitutional order. The criminal charges will be submitted to the Prosecutor’s Office of the Federation of BiH and the Prosecutor’s Office of the Republika Srpska.

The National Assembly of the Republika Srpska tasks the Government of the Republika Srpska with preparing and submitting to the Parliament laws that will prohibit the activities of bodies that are not defined by the Constitution of BiH on the territory of the Republika Srpska, in particular the High Judicial and Prosecutorial Council of BiH, the Court of BiH, the Prosecutor’s Office of BiH and the Agency for Investigation and Protection of BiH, the conclusions state.

The National Assembly strongly condemns the actions of the Prosecutor’s Office of BiH towards the members of the Parliament, due to the actions they perform within the scope of their duties, which have as their ultimate goal intimidation and political neutralization, and opposes any actions taken by the Prosecutor’s Office of BiH and other bodies acting on their orders towards the members of the Parliament.

These conclusions shall enter into force on the day of their adoption.

The occasion for the session of the National Assembly of the Republic of Srpska is the first-instance verdict of the Court of BiH, which found the President of the Republic of Srpska Milorad Dodik guilty of disrespecting the decisions of the High Representative in BiH. The court sentenced Dodik to one year in prison and a ban on holding the office of President for six years from the date the verdict became final. This decision can be appealed.
