The Basic Court In Banja Luka Rejected The CEC’s Proposal To Strip Dodik Of The Function Of SNSD President

The Basic Court in Banja Luka rejected the proposal of the Central Election Commission of Bosnia and Herzegovina (CEC BiH) to delete Milorad Dodik from the register as the authorized person for representing the SNSD.

The Basic Court in Banja Luka, deciding on the CEC’s proposal that the court, by official duty, initiate a non-contentious procedure for the deletion of Milorad Dodik as the person authorized to represent the political organization SNSD from the register of political organizations kept by this court, in a panel composed of three judges, issued a decision on November 24th rejecting the CEC’s proposal of October 22nd, it was announced by the Court of BiH.

They added that such a decision was made “considering that neither the Law on Non-Contentious Procedure, nor the Law on Political Organizations, nor any other law stipulates that the court, which keeps the register of political organizations by official duty, initiates a procedure for the deletion of the person authorized to represent a political organization from the register.”

An appeal against this decision is allowed to the District Court in Banja Luka within eight days of receipt of the decision, through this court, stated the Basic Court in Banja Luka.

The procedure regarding whether Milorad Dodik can remain the president of SNSD was initiated after the Court of BiH, by a final verdict, banned him from performing public functions for six years.

The Court of BiH sent a letter to the CEC on October 16th explaining the verdict to Dodik and requesting that the CEC implement it fully, stating that Dodik cannot perform any duty in bodies that are financed from public funds.

The Court of BiH then cited laws and the Statute of SNSD, but did not explicitly state a ban on Dodik being the leader of SNSD, asking the competent authorities to implement the law.

The CEC previously announced that they are not competent for this issue, which is why they forwarded the letter with the verdict and the decision on stripping Milorad Dodik of his mandate to the Basic Court in Banja Luka, as well, which is competent for the registration of political subjects in the court register.

The CEC, at the beginning of August, based on the court verdict, stripped Dodik of the mandate of President of Republika Srpska (RS), but he remained at the head of SNSD.
