A little more than three months remain until the implementation of the Law on Control and Limited Use of Tobacco, Tobacco Products, and Other Smoking Products. It is about a law that, when it was adopted last March, caused reactions in the public, and the application of which begins one year after it comes into force, that is, on May 26th.
According to that law, smoking is prohibited in all closed public spaces, workplaces and public transport. It is also prohibited to use tobacco products for smoking in private means of transport in which minors are present.
Special rooms
Obligations for natural persons begin on the date of application of this law. Legal entities are obliged to harmonize their acts with the provisions of the Law within six months from the beginning of the application of this law, i.e. by November of this year.
By-laws include conditions for special smoking rooms in terms of exceptions to the smoking ban.
Thus, smoking will be allowed in special areas designated for smokers for the accommodation of guests in accordance with the regulations on the hospitality industry, which must be indicated by a smoking permit sign in such areas.
In an establishment where drinks are exclusively served, the owner or user of the facility can designate the serving area as a smoking area with a prominent smoking permit sign.
As Jasmina Cekric, a member of the Federal Commission for the Control of the Use of Tobacco, Tobacco Products, and Other Smoking Products, said, the tobacco industry is obliged to harmonize its work and operations with the provisions of the Act within 18 months from the beginning of the application of the Act, i.e. from the date of entry into force of the by-laws passed on the basis of this law.
Anticipated penalties
Fines prescribed by this law will begin to be charged after 12 months from the start of application of this law, that is, from the day of entry into force of the by-laws adopted on the basis of this law, Avaz reports.
