A Longer Sentence or Acquittal for the Crime in Strpci

During the presentation of appeals against the first-instance verdict by which Boban Indjic was sentenced to 15 years in prison for a war crime against the civilian population committed in 1993 in the area of Visegrad, the State Prosecution proposed to the Appellate Council, among other things, to sentence him to a longer prison sentence, while the Defense requested that he be acquitted or that a new trial be ordered.

The prosecution filed an appeal due to significant violations of the provisions of the criminal procedure, wrongly and incompletely established factual situation, as well as due to the length of the prison sentence.

The defense also filed an appeal due to the violation of the right to a fair trial, significant violations of the provisions of the criminal procedure, violation of substantive law, wrongly and incompletely established factual situation, and the length of the imposed sentence.

The Substitute Prosecutor, Ahmed Mesic, suggested that the verdict be canceled or changed, that is, that Indjic be sentenced to a longer prison term. He did not specifically explain the other appeal allegations, but he did refer to the imposed prison sentence and said that the First Instance Panel did not properly weigh the circumstances that could have caused it to be higher.

The defense stated at the hearing that it considers the verdict illegal.

“As a professional, it is incomprehensible to me that Boban Indjic was convicted in the case against Luka Dragicevic,” said lawyer Senad Kreho reminded that Indjic’s case was separated and given a new number.

Since 2015, Indjic has been on trial with Luka Dragicevic and seven other former members of the Visegrad Brigade, but the proceedings against him were separated in 2021 because he was convicted in Serbia of causing a traffic accident. After serving his sentence, his trial continued.

The Council will make a decision on appeals within the legal deadline.
