BH Court sentences Emir Alisic for Organizing a Terrorist Group

Having held a hearing to deliberate on a guilty plea agreement and a sentencing hearing, the Court of Bosnia and Herzegovina handed down, on 5 January 2021, a judgment in the case of Emir Ališić finding the accused Emir Ališić guilty of commission of the criminal offense of Organizing a Terrorist Group under Article 202d (2) in connection with Paragraph (1), all in connection with the criminal offense of Terrorism under Article 201 of the Criminal Code of Bosnia and Herzegovina (CC BiH). The Court sentenced the accused Emir Ališić to imprisonment for a term of two (2) years and six (6) months. Pursuant to Article 56 of the CC BiH, the time the accused spent in custody, running from 19 December 2019 onwards, shall be credited towards the imposed prison sentence.

The accused Emir Ališić has been found guilty because he had left Bosnia and Herzegovina on 13 December 2013 with the intent to join the terrorist organizations “Jabhet al-Nusra”, “Al-Nusrah Front” and “ISIL” of the so called Islamic State in the Territory of Syria and Iraq, which were under the UN Security Council Resolution of 30 May 2013 listed as terrorist groups and organizations. After crossing the border between Turkey and Syria, the accused joined and became a member of the of an unidentified paramilitary formation and a member of a paramilitary formation or so called “Bejt Commandos” Unit. The referenced formations formed part of the ISIL in the territory of the towns of Raqqa and Haritan, whose member the accused was during the period between December 2013 and the beginning of 2019, when he surrendered to the Kurdish forces, which captured him in the Syrian territory, as a result of which he was deported to Bosnia and Herzegovina on 9 December 2019.
