BiH Court to Sentence Mirza Kapic Today for Planned Terrorist Attack

The Court of Bosnia and Herzegovina will today pronounce the first-instance verdict against Mirza Kapić, accused of planning a terrorist attack on a mosque in Zenica.

The BiH Prosecutor’s Office requested that Kapić be convicted and ordered to undergo mandatory medical treatment, while the defense proposed his release.

According to the BiH Prosecutor’s Office, the accused is ready to commit a criminal offense, is known to the police, has been convicted, and has been to Syria and acquired automatic weapons.

Prosecutor Dubravko Čampara previously stated that the BiH Prosecutor’s Office reacted when they received information from the State Investigation and Protection Agency (SIPA) that a terrorist attack on a mosque in Zenica was being prepared and would be carried out, using an explosive device, and that they searched the house on the order of the Court and arrested Kapić.

Čampara stated that mobile phones, laptops and two flags reminiscent of the flags of the terrorist organization “Islamic State” were seized at that time, reports Birn.

“What is evident are the messages and content from which it is evident that Mirza Kapić, with a person he knows, was trying to find out how to make an explosive device from his phone via the ‘Telegram’ application,” said Čampara.

He stated that it is clear and unequivocal that Kapić received information on how to make an explosive device and that he explained that he would place it in a mosque in Zenica, which the Prosecution considers to be the main motive because the accused sent a photo of the mosque in the conversation.

The prosecutor referred to the expert’s findings, which stated that there was a possibility that Kapić would repeat the criminal offense and that he was a very dangerous person, and in the end requested a sentence and that he be given a security measure of mandatory medical treatment.

Kapić is accused of having, in mid-2023, with the aim of seriously intimidating the population and destabilizing society, used internet applications via mobile phone to arrange and plan an attack on the “Bosna” mosque in Zenica, with the aim of seriously intimidating the population and destabilizing society, with persons known to him, using internet applications via mobile phone, to carry out an attack on the “Bosna” mosque in Zenica, which he would carry out by placing an explosive device.

As reasons for the rejection or acquittal verdict, defense attorney Lejla Babić stated that the defendant’s right to defense was violated, and that he was not questioned in accordance with legal provisions.

According to her, the indictment could never have been filed and what was described does not constitute an act of terrorism.

According to the defense, it is unclear how the population was intimidated, for which, they claim, no evidence was presented, and the population learned about Kapić from media articles when the indictment was filed.

“The prosecution has not proven what the motive for the attack on this mosque was,” Babić said, adding that nothing was found in the search of the house except for two flags, the symbolization of which has not been proven.

She said that Kapić suffers from a personality disorder, emotional immaturity that makes him need to prove to himself, that he is not a socially dangerous person and that he has adjusted his behavior to social norms.
