BiH Utility Company, despite the Judgments of the Court of BiH, gives Jobs to the Chinese

After the murky affairs during the construction of Block 7 and the revitalization of Block 6 in the Tuzla Thermal Power Plant, in which the company ITC Zenica and its Chinese partners, the most responsible people in Elektroprivreda of Bosnia and Herzegovina (EPBiH), and individual members of the Appeals Review Office are involved, this story is slowly taking on a new form.

According to the information, the investigative bodies are seriously dealing with this case and the Court of BiH on October 21st, 2022 annulled the Decision of the Appeals Review Office, which favored ITC Zenica in getting work on the revitalization of the boiler of Block 6 of the Tuzla Thermal Power Plant, To make the situation even more difficult, the competing Consortium on that job filed a lawsuit demanding compensation from EPBiH and the Appeals Review Office for the illegally awarded contract in favor of ITC Zenica, which is greater than 20 million BAM.

Admir Andelija – general director of EPBiH, Ruzica Buric – executive director for legal affairs of EPBiH, Senad Salkic – executive director for capital investments of EPBiH, Muhamed Kozadra – executive director for economic affairs of EPBiH, Marko Kolobaric – chairman of the Office for Review of Appeals of BiH, and Adin Kondzic, Larisa Demirovic and Sanela Salihovic, members of the Office for Review of Appeals, have been reported to the Prosecutor’s Office of BiH.

All eight are charged with the criminal offenses of Abuse of position or authority from Article 220 of the BiH Criminal Code, Embezzlement in the service from Article 221 of the BiH Criminal Code and unconscionable work in the Service from Article 224 of the BiH Criminal Code, which caused millions of damages to EPBiH and to the benefit of the consortium gathered around the company ITC Zenica. The owner of this company is Suvad Isakovic, who recognized a job opportunity in wartime Zenica in 1994 and in the aforementioned business environment started the company ITC, which, until recently, was engaged in the sale of agricultural machinery and the production of greenhouses, and recently became an “especially valued” partner in EPBiH.

One source in EPBiH claims that everything is taking place according to the established pattern: EPBiH announces a tender (negotiation procedure) to which ITC Zenica applies in a consortium with companies that have references that ITC lacks. In the event that another company or consortium is more favorable, ITC complains to the Appeals Office, which, as a rule, accepts ITC’s appeal, and the authorities in EPBiH then have the perfect alibi to conclude a contract with a less favorable bidder, i.e. ITC. During the execution of the works, there is no adequate control of compliance with the provisions of the contract, and of course also any penalization of ITC Zenica for the obvious damage it caused to the company EPBiH, Vijesti.ba reports.
