Conclusions on the Meeting of the Officials of RS

parliament rsAt yesterday’s meeting, representatives of Republika Srpska (RS) with the President of RS Milorad Dodik unanimously rejected the decision of the Constitutional Court of B&H on the unconstitutionality of the Day of RS, on the 9th of January.

After the meeting at the Palace of Republika Srpska in Banja Luka, they stated that they will request from the Parliamentary Assembly to adopt a new law on the Constitutional Court in the period of 120 days, by which foreign judges would be expelled from this institution.

“We unanimously agreed to reject the decision of the Constitutional Court of B&H and stick to the Declaration adopted by the National Assembly of RS,” stated Dodik.

He also announced a referendum in the RS, where the people would declare whether they support the decision of the Constitutional Court of B&H and whether they are for the 9th of January to remain the Day of RS.

To recall, on the 26th of November the Constitutional Court of B&H on the appeal of member of the B&H Presidency Bakir Izetbegovic, assessed that Article 3b of the Law on Holidays of Republika Srpska is not in accordance with the Constitution of B&H since that day, the 9th of January, is the day when the “Parliamentary Assembly of Serbian people in B&H” adopted Declaration on the Republika of Serbian People of B&H in the areas of the Serbian Autonomous Regions and Districts and of other Serbian ethnic entities in B&H.

National Assembly of RS was ordered to coordinate the Article 3b of this law with the Constitution of B&H within 6 months.

“The Constitutional Court underlines once again that this decision in no way is questioning the right of citizens of B&H of Orthodox religion (as well as the right of citizens of any other religious community in B&H) to mark their holidays freely on the traditional, or any other suitable way, including the holiday of St. Stefan. According to of the Constitutional Court of B&H, such freedoms and rights, in particular their free manifestation, are only confirming multi-confessional and multi-cultural character of B&H as a state and society. Therefore, this decision of the Constitutional Court of B&H cannot be understood in no other way in this context,” as announced in the statement.
