Court of BiH delivers Appeals Judgments for several Cases

On 20 August 2018, the Appellate Panel of the Court of Bosnia and Herzegovina delivered an appeals judgment in the case of Jasmin Selimagić et al. dismissing as ill-founded the appeal filed by the BiH Prosecutor’s Office, while upholding the trial judgment of the Court of BiH dated 28 June 2018.

The trial judgment had acquitted the accused Jasmin Selimagić and Anđelko Novaković  of the charges that they committed the criminal offense of Organized Crime under Article 250(2) of the CC BiH as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH.

The Court acquitted the accused Jasmin Selimagić and Anđelko Novaković of the charges that in June and July 2014, while G.K. was serving his prison sentence, as members, together with persons bearing initials I.K., Z.V. and other persons known to them, they joined a group for organized crime that had been organized and run by G.K. for the purpose of unauthorized international purchase, transfer, transportation, keeping, mediation in further international sale, import and export, shipping and delivering the narcotic drug of Cannabis sativa L.-marijuana, from the territory of Montenegro to the territory of BiH, with the aim of obtaining ill-gotten gain.

Pursuant to Article 391(1) of the BiH Criminal Procedure Code, as read with Article 195(4) of the CC BiH, the Court has confiscated the narcotic drugs found during the special investigative measure of simulated purchase and controlled purchase of certain objects and simulated bribery under Article 116(2)f) of the CPC BiH.

The Appellate Division Panel of Section I for War Crimes at the Court of Bosnia and Herzegovina, in the criminal proceeding against the accused Đorđe Simić, having held a Panel session, delivered a judgment dismissing the appeal filed by the BiH Prosecutor’s Office as ill-founded, while upholding the trial judgment delivered by the Court of Bosnia and Herzegovina No. S1 1 K 024042 17 Kri of 10 April 2018.

The trial judgment delivered by the Court of Bosnia and Herzegovina No. S1 1 K 024042 17 Kri of 10 April 2018 acquitted the accused Đorđe Simić of the charges that by the actions described in the operative part of the judgment he committed the criminal offense of Crimes against Humanity under Article 172(1)i) of the Criminal Code of Bosnia and Herzegovina (CC BiH) as read with Article 180(1) of the CC BiH

The pronouncement of trial judgment in the Milan Novaković case has been scheduled for 26 October 2018, at 1 p.m., Courtroom 8.

On 23 July 2018, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Milan Novaković with the criminal offense of Tax Evasion or Fraud under Article 210(4) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with Paragraph 1, all in conjunction with Articles 31 and 54 of the CC BiH.

The pronouncement of judgment in the case of Ivan Medić et al. has been scheduled for 26 October 2018, at 1 p.m., Courtroom 7.

The Indictment charges the accused Tonćo Rajič with the criminal offense of War Crimes against Civilians under Article 173(1)c), as read with Article 180(1) and Article 21 of the Criminal Code of Bosnia and Herzegovina.
