Cvijanovic claims that the Constitutional Court of BiH does not have Jurisdiction over Becirovic’s Appeal

Željka Cvijanović, a member of the Presidency of Bosnia and Herzegovina, commented on the move by Denis Bećirović, the chairman of this body, who sent an appeal to the Constitutional Court of Bosnia and Herzegovina.

His move came after the National Assembly of Republika Srpska (NSRS) recently supported Cvijanović’s veto regarding the appointment of members of the Commission for the Preservation of National Monuments of Bosnia and Herzegovina.

Cvijanović said that it is his right to address whichever institution he wants, just as it is her constitutional right to address the NSRS, which she did.

“This prevents the entry into force of the decision that I declared very harmful to the vital interest of the RS, which was made by over-voting a member of the Presidency,” said Cvijanović for Srna.

She emphasized that the National Assembly of Republika Srpska put an end to the process of making such decisions.

“During previous addresses to the Constitutional Court of Bosnia and Herzegovina, he declared himself incompetent because it is Annex eight of the Dayton Agreement, which is not within the jurisdiction of the Constitutional Court of Bosnia and Herzegovina, and not Annex four, which is the Constitution of Bosnia and Herzegovina,” said Cvijanović.

She states that the Commission for the Preservation of National Monuments was never given the right under Annex 8 to interfere in urban planning, planning documentation, to stop or approve construction and similar issues.

“For this reason, they asked for guarantees from UNESCO that a foreign representative will not engage in this. There is no legal basis for such activity. Whoever engages in this, whether he is a local or a foreign member, is committing an illegal act. So whoever likes it, let him go. In addition, I expect the competent authorities to investigate whether there was abuse of official position and the acceptance and management of donor funds outside of the prescribed procedure when it comes to the actions of the executive functionary or members of the Commission from FBiH,” said Cvijanović.
