Dž. Selman: We must adopt the law on the Court of BiH and organize the appellate jurisdiction

President of the Constitutional Court of RS Džerard Selman, who headed the delegation of RS in structural dialog about the reform of the judiciary between the EU and BiH, believes that BiH should adopt the law on the Court of BiH in order to regulate the appellate jurisdiction in accordance with the Constitution of BiH.

He said that, by deciding appeals, the Constitutional Court of BiH goes outside its jurisdiction and assumes the role of the Supreme Court of BiH which is not its competence.

Selman said that RS wants in the continuation of the structural dialogue to reach a consensus at the level of BiH, and to organize the Court and the Prosecution Office of BiH in accordance with the Constitution of BiH, RS and FBiH.

“It is about the transfer of authority and we are ready, if we adequately agree, to sign an agreement on the transfer of responsibility for the formation of the Court of BiH as the trial court and the Appellate Court as the second level of court system” said Selman.
