EU Foreign Affairs Committee: The Vote on the Constitutional Court of BiH in the NSRS has no legal Basis

The spokesperson of the European Service for Foreign Affairs and Security Policy, led by Josep Borrell, spoke about the decisions of the National Assembly of Republika Srpska not to accept the new decisions of the Constitutional Court of Bosnia and Herzegovina.

Nabila Massrali, on behalf of the EU Foreign Affairs Committee, pointed out that “the authority and integrity of the Constitutional Court of Bosnia and Herzegovina as the highest judicial body of Bosnia and Herzegovina is unquestionable”.

“It’s decisions, which are final and binding throughout the country, must be respected. The National Assembly of the Republika Srpska does not have the authority to decide on the non-application of the decisions of the Constitutional Court of Bosnia and Herzegovina. That is why yesterday’s vote on the non-application of the decisions of the Constitutional Court of Bosnia and Herzegovina in the Republika Srpska without legal basis,” said Massrali.

In addition, he adds that voting in the NSRS is contrary to what is expected of BiH, given its status as an EU candidate.

“The vote marks a clear departure from the expectations that accompanied the granting of candidate status for EU membership. The termination of cooperation on the achievement of key EU priorities is regrettable and completely contradicts the wishes and interests of all citizens of Bosnia and Herzegovina,” he said.

In the end, she pointed out that “the EU has consistently demonstrated that it is a loyal partner to Bosnia and Herzegovina with an unequivocal commitment to the country and its perspective of joining the EU as a single, united and sovereign state”.
