From September 28, 2026, the Federal Administration for Inspection Affairs will begin the implementation of the Special Program of Inspection Oversight of the Application of the Law on Prevention of Money Laundering and Financing of Terrorist Activities by taxpayers from the non-financial sector, which will be implemented by the Federal Market Inspectorate by the end of the year.
With a special program, the Federal Administration for Inspection Affairs, within its competences, contributes to the implementation of the Action Plan for Bosnia and Herzegovina from June 2026 according to the FATF (Financial Action Task Force), an international body that sets standards in the field of preventing money laundering and financing terrorist activities.
One of the measures of the Action Plan refers to the provision of coordinated and risk-based supervision over the application of regulations on the prevention of money laundering and financing of terrorist activities by taxpayers from the non-financial sector.
The program covers all categories of taxpayers from Article 5 of the Law that are under the jurisdiction of FUZIP, including organizers of games of chance, audit firms, providers of bookkeeping, accounting and tax services, providers of certain financial and corporate services that are not under the supervision of the financial sector regulator, and service providers of trusts and companies.
The program includes dealers in vehicles, vessels and aircraft, dealers in precious metals, precious stones and works of art, and real estate brokers, in the cases and under the conditions prescribed by the Law.
Federal market inspectors will check on the ground whether the obligors have established and in practice apply the legally prescribed measures to prevent money laundering and financing of terrorist activities. Controls will include the way in which taxpayers assess and manage risks, identify and monitor clients and business relationships, keep prescribed records, apply internal procedures and controls, and act in case of suspicious transactions.
All taxpayers who have not done so so far are obliged to submit their own assessment of the risk of money laundering and financing of terrorist activities to FUZIP.
The law stipulates fines ranging from 5,000 to 200,000 BAM for violation of prescribed obligations. Penalties in the range of 20,000 to 80,000 BAM are prescribed for obligees failing to perform a risk analysis and failing to identify and monitor clients, keep certain records and other obligations that will be subject to control.
