More than 70 Prison Sentences have been replaced by Fines in BiH

The Court of Bosnia and Herzegovina issued more than 70 decisions to replace prison sentences with fines between 2024 and mid-2025, with a total of 201,000 BAM collected, the Court of BiH said.

During 2024, the Court of BiH replaced prison sentences with fines in 49 cases, while in the first half of 2025, a total of 22 decisions to replace sentences were issued.

The most frequently replaced sentences in Bosnia and Herzegovina relate to various criminal offenses, including abuse of office, unauthorized recording and transmission of content, association for the purpose of committing criminal offenses, receiving gifts and other forms of benefit, smuggling, incitement to prostitution, illicit trafficking in narcotic drugs, failure to report criminal offenses, and providing assistance to the perpetrator of a criminal offense.

These offences cover a wide range of criminal activities, from corruption and abuse of office, to protecting the privacy and security of citizens, to combating drug trafficking and other dangerous activities.

Appropriate prison sentences are prescribed for them, in accordance with the gravity and consequences of the offence.

The substitution of a prison sentence for a fine does not apply to criminal offences against the integrity of Bosnia and Herzegovina, terrorism, financing of terrorist activities, public incitement to terrorist activities, recruitment for terrorist activities, training for the performance of terrorist activities and organisation of a terrorist group.

The judge/panel that issued the first instance verdict is competent to decide on the request of a convicted person to substitute a prison sentence for a fine, according to the Court of BiH.
