OHR: Everyone must respect the Judgment of the Constitutional Court

ohrOHR is considering the decision of the National Assembly of RS on holding a referendum on the 9th of January as the Day of RS, according to the Office of the High Representative.

“Although it is evident that the holidays are sensitive topic in BiH, the rule of law must be respected. Let me repeat that all the authorities in BiH, including those in the RS, have the obligation to implement the final and binding verdict of the Constitutional Court of BiH.”

“Efforts to bypass this obligation using the referendum or in any other way, does not release the specific authority from obligation that is clearly stated in the Peace Agreement. The Constitutional Court of BiH is one of the key pillars of the Dayton framework, and its decisions must be respected and implemented in order to comply with the Constitution of BiH and the rule of law, which is in the interest of everyone in this country,” as stated from the OHR.

To recall, the National Assembly of the RS made a decision to hold referendum on the 9th of January as the Day of the RS, and the day of the referendum will be determined until the 25th of September 2016.

The National Assembly of the RS adopted the decision on holding a referendum with 63 votes “for” and elected and appointed Republic Commission for the implementation of the referendum.
