OHR about the possible Lawsuit against Serbia

ohrThe Office of the High Representative in BiH (OHR) did not want to make any suggestions to the Bosnian government in relation to the initiation of possible lawsuit against Serbia for genocide. However, they pointed out that it is up to BiH to decide whether the complaint will lead to progress in the country.

“It is up to BiH to consider whether the new facts are established and taking into consideration that, to decide whether is possible to take next steps and whether they will contribute to justice, reconciliation and progress in the country”, is announced from the OHR.

To recall, the head of the OSCE Mission to BiH Jonathan Moore advised authorities not to initiate a lawsuit because there are no conditions.

February 27th  is the deadline for initiating the lawsuit against Serbia and Montenegro for genocide before the International Court of Justice in The Hague. The agent for BiH in this dispute is Sakib Softic.

In 1993, BiH sued Serbia as the first country in history that has sued another country for violating the Genocide Convention. After, 14 years, the Court rejected Serbia as responsible for genocide, but has confirmed that genocide occurred in Srebrenica.

Thus, Serbia is the first country in the world convicted for failing to prevent the genocide. For the judgment in 2007 there was no right of appeal, but BiH is given a period of ten years for filing a request for review.
