Osmanovic: If there is no Reaction from the OHR, we will enter Anarchy

Chairman of the Caucus of the Party of Democratic Action (SDA) in the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (PABiH) Adil Osmanovic said that yesterday’s session of the National Assembly of the Republika Srpska (NARS) entity, where the draft law on the RS High Judicial and Prosecutorial Council was supposed to be discussed, as well as immovable property used for the functioning of public authorities, represents the most brutal attack on the Dayton Peace Agreement to date.

”We expect the High Representative to move from words to deeds. We welcome the concern and the direct warning that the NARS is not moving in this direction, but we expect that after today’s session the High Representative will sanction all those working to overthrow the Dayton Peace Agreement,”Osmanovic said yesterday at a press conference in Sarajevo.

”What I want to emphasize is that the authorities of the RS entities, 12 deputies from the House of Representatives of the PABiH, initiated a constitutional review procedure before the BiH Constitutional Court in 2008 regarding the enactment of the Law on the High Judicial and Prosecutorial Council of BiH (HJPC),” Osmanovic added.

”State competence cannot be transferred to the entity because there is no constitutional basis for that, and this is clearly stated in the decision of the Constitutional Court I mentioned. Once the entities agree and the PABiH adopts it, the procedure is completely clear,” he pointed out.

He explained that if the delegates in the PABiH have complaints or objections to the HJPC Law, they should initiate it before the PABiH and open debates there, which is the only right way.

”If there is no reaction from the High Representative, we are entering anarchy and it turns out that those who are not ready to abide by the Constitution and the law can do everything when it comes to this country. This must not be allowed and we expect reactions from representatives of the international community and the Prosecutor’s Office of BiH, ” Osmanovic emphasized.
