The Special Department for the Suppression of Corruption, Organized and Intercantonal Crime of the Federal Prosecutor’s Office of the FBiH (POSKOK) filed an indictment against Marin Nikolić, Elmedin Voloder, Boris Zelić and Reuf Kadrić for abuse of office and tax fraud.
“The indictment refers to actions related to the procedure for establishing the Ljubatovići landfill and the expropriation of land for the construction of the 21.3-kilometer long subsection of the Medakovo-Ozimice highway on Corridor Vc,” the Federal Prosecutor’s Office announced.
According to the indictment, Marin Nikolić is accused of organizing a group joined by Elmedin Voloder, Boris Zelić and Reuf Kadrić in the period from August 2022 to May 2023, with the aim of obtaining illegal property benefits for Boris Zelić through the process of land expropriation in the area of Ljubatović.
The indictment accuses them of having, using their business and official positions and mutually agreed upon activities, undertaken actions in order to amend the existing project documentation, establish a new Ljubatovići landfill, and initiate the process of complete land expropriation for the construction of the Medakovo-Ozimice subdivision, even though, according to the indictment, the contractor was ready to establish a temporary landfill at his own expense, and the designer had previously expressed the view that there was no need for a new landfill, thereby ignoring the interests of JP AC F BiH, and based solely on the interests of Boris Zelic in order to obtain illegal financial benefits for him.
According to the indictment, Boris Zelić had previously bought land that was subsequently included in the expropriation process, after which JP Autoceste of the Federation of Bosnia and Herzegovina paid him 851,905.70 KM for the expropriated real estate. The Prosecution alleges that in this way he obtained illegal property benefits in the amount of at least 702,305.70 KM, while JP Autoceste of the Federation of Bosnia and Herzegovina suffered material damage in the amount of 2,535,514.96 KM, which, according to the indictment, was the cost of land expropriation for the Ljubatovići landfill.
Boris Zelić is additionally accused of having presented the purchase and sale prices to the competent authorities lower than those actually contracted and paid during the purchase of certain properties, and of having submitted such information to the Tax Administration of the Federation of Bosnia and Herzegovina.
The indictment charges Marin Nikolić with the criminal offenses of Association for the purpose of committing criminal offenses and Abuse of position or authority, while Elmedin Voloder and Reuf Kadrić are charged with membership in an association and abuse of position or authority. Boris Zelić is charged with membership in an association, assisting in the commission of the criminal offense of abuse of position or authority, and the criminal offense of Filing a false tax return.
Over 50 witnesses, four experts and over 500 pieces of material evidence were proposed for the main trial.
The investigation in this case was carried out in intensive cooperation with the Federal Police Administration, whose police officers, under the supervision of the acting prosecutor, undertook a significant part of the investigative activities.
The indictment was sent to the Special Department of the Supreme Court for confirmation.
