Request by the RS rejected, Referendum banned?

ustavni_sud (1)The 99th plenary session of the Constitutional Court of Bosnia and Herzegovina was held yesterday. At the session, the request for reconsideration of the decision on the celebration of January 9 as the Day of RS was rejected.

The Constitutional Court of BiH rejected the request for reconsideration of the decision by the Constitutional Court of BiH, thus finally confirming that January 9 is unconstitutional. Moreover, the Constitutional Court reached a decision on temporary suspension of the referendum in the RS.

In November last year, the Court reached a decision which declared the Day of RS, January 9, unconstitutional, claiming that it violates the rights of Croats, Bosniaks and other non-Serb population in Republika Srpska.

This decision was neglected by the political representatives of Republika Srpska, who scheduled a referendum on the celebration of the Day of RS on September 25.

The Constitutional Court also adopted a temporary suspension measure for the Decision on the organization of a referendum in Republika Srpska. Seven out of nine judges of the Constitutional Court of BiH voted for all decisions adopted yesterday.
