RS Constitutional Court: Vital National Interest of Bosniaks violated

The Council for the Protection of Vital Interests of the Constitutional Court of Republika Srpska has determined that the Law on the Protection of the Constitutional Order of Republika Srpska, adopted by the National Assembly of Republika Srpska, has violated the vital national interest of the Bosniak people.

This Law was adopted by the National Assembly on 13 March 2025, and the Council has determined that the Law does not contain a legal mechanism to ensure the representation of constituent peoples and others when appointing judges and prosecutors to the Special Court and Prosecutor’s Office for the Protection of the Constitutional Order of Republika Srpska, as well as to the Appellate Division for the Protection of the Constitutional Order.

As a reminder, the Law on the Protection of the Constitutional Order of Republika Srpska, adopted by the National Assembly of Republika Srpska, provides for the establishment of a special prosecutor’s office and a special court of Republika Srpska.
