The EU Delegation to BiH on the Issue of the Referendum in RS

andyThe existence of the state-level judiciary is not in question, was stated among other things today for from the EU Delegation to BiH when asked to comment announcement of President of Republika Srpska Milorad Dodik on referendum in that entity on state judicial institutions.

In the answer signed by spokesperson of the EU Delegation and the EU Special Representative to BiH Andy McGuffie, it is stated that the plenary meeting of the EU-BiH Structured Dialogue on Justice and Additional Rule of Law Matters is planned for 13-14 July 2015.

“Reform of the state level judiciary and war-crimes processing remain priority issues, which are maintained on top of the agenda. The existence of the state-level judiciary is not in question. Yet, it has been acknowledged that there are certain shortcomings in the existing system, which shall be addressed with targeted reforms, based on the consensus within the Structured Dialogue,” stated McGuffie.

According to him, there are clear recommendations adopted by the Venice Commission and the European Commission to indicate possible trajectories of reform. Authorities in Bosnia and Herzegovina are expected to build on such guidance and guarantee a sound reform of the system, based on the largest possible consensus, which would bring the domestic judiciary in line with relevant European standards and Acquis.

“A lot of work and resources have been invested in facilitating preparation of the reform package and build consensus, amongst both the community of practitioners and politicians. The EU reiterates that citizens throughout Bosnia and Herzegovina deserve a fully independent, accountable, efficient and professional judiciary. This is crucial for the overall entrenchment of the rule of law, but also a precondition for joining the European Union,” concluded McGuffie.
