The Cantonal Court in Sarajevo returned the indictment against the tram driver Adnan Kasapović to the Canton Sarajevo Prosecutor’s Office for a serious criminal offense against the safety of public traffic and endangering public traffic.
The CS Prosecutor’s Office filed the indictment at the beginning of September, but they did not respond to Detektor’s inquiry, which is why it was sent back for revision.
Earlier, they stated that the indictment was brought after extensive investigations, team expert reports and a large amount of collected evidence.
In the accident that happened in mid-February when the tram derailed, one person died, while four were injured, one of them seriously. After the accident, the Prosecutor’s Office requested the detention of the tram driver due to the danger that the public could be disturbed if he was released, but the Cantonal Court in Sarajevo rejected the proposal.
The Prosecutor’s Office announced that in relation to the allegations of anonymous reports and media articles about the servicing of magnetic brakes, the video surveillance system and marketing contracts for the lease of advertising space in tram vehicles, after checks and analysis of the evidence, an order was issued not to conduct an investigation, since the reported acts are not criminal.
Detektor previously wrote that KJKP GRAS did not ask for previous experience or expertise of the company in the tender for servicing magnetic brakes on the type of tram that was involved in the accident.
The owner of the company that won the tender said that he had no experience with these brakes and that he had not returned any of the serviced brakes to GRAS during the eight months of the contract. GRAS did not respond to the inquiry when they last serviced the brakes on tram 516.
The company that supplied parts for the engines of GRAS’s old trams was founded only a year and a half before the tender, and the owner is connected to the Minister of Economy in Zenica. The Minister of Transport in the CS Government, Adnan Šteta, granted this company, with an exemption from procurement procedures, 150,000 BAM for assessing the quality of the transportation network in Sarajevo.
Detektor also wrote that in March GRAS announced two tenders for the procurement of brakes and other parts for old Czech trams that were temporarily withdrawn from use after an accident in which such a tram killed one and injured four people. For the purposes of this tender, previous experience of the company was requested, reports BIRN BiH.
