The Venice Commission calls on the NARS to withdraw the Call for the Resignation of Judge

The Venice Commission is seriously concerned about the call for resignation sent by the Assembly of Republika Srpska to the Vice President of the Constitutional Court of Bosnia and Herzegovina Zlatko Knežević, who is one of the two judges elected by the National Assembly of the RS, and also a member of the Venice Commission for Bosnia and Herzegovina – it was announced from the Council of Europe.

The statement states that the fundamental guarantee of the independence of the Constitutional Court is that its members cannot be recalled or replaced, nor can those who appointed them be asked to resign for political reasons.

In agreement and in support of the statement of the Constitutional Court of Bosnia and Herzegovina from April 27, the Venice Commission therefore calls on the Assembly of Republika Srpska to withdraw its call for the resignation of Vice President Knežević.

“The Constitutional Court of Bosnia and Herzegovina should be able to continue its important work on the defense of democracy, human rights and the rule of law for the benefit of all people in BiH, in all parts of the country, without interference,” the statement from the Council of Europe states.
