The Council of the Congress of Bosniak Intellectuals organized a public panel discussion titled ‘All-Serb Assembly – An Attack on the Constitutional Order of Bosnia and Herzegovina (BiH)’ on the day when the unconstitutional Day of Republika Srpska (RS) is marked, in order to point to the continuity of Greater-Serbian expansionist policy.
As emphasized, in the 1990s, this policy was announced by Slobodan Milosevic with the slogan “All Serbs in One State.” By convening the so-called All-Serb Assembly in the summer of 2024 and adopting a declaration, various activities aimed at the de facto annexation of the BiH entity RS to a neighboring state were announced. By this, as stressed at the Council of the Congress of Bosniak Intellectuals, a multiple attack on the constitutional order of BiH and on the Dayton Peace Agreement was committed.
Introductory speaker Harun Isceric, a senior teaching assistant at the Faculty of Law in Sarajevo, reminded at yesterday’s gathering that 18 months have passed since the holding of the All-Serb Assembly and the adoption of the declaration at that assembly, and during that time the authorities in RS and the Republic of Serbia have undertaken various actions with the aim of implementing that declaration.
“The declaration has not remained a dead letter, and what stands out in particular are legislative activities, joint marking of various holidays, and the establishment of new joint institutions, the renewal of earlier ones, and the establishment of special public institutions in the BiH entity RS,” he told journalists, among other things.
Professor Enver Imamovic also referred to the marking of January 9th and described those events as unbelievable.
“I will say this as a citizen of BiH: what is happening in the Serb Republic, specifically today in Banja Luka, is unbelievable. Unbelievable in the sense that an institution of that level defies all people and all other institutions in BiH. What they are doing is a demonstration of force, but in the long run, it will not last. They are digging a hole for themselves; they will truly be the losers because it has not been recorded that in one state an institution (of that level) defies the highest judicial instance, such as the Constitutional Court,” he emphasized.
The President of the Council of the Congress of Bosniak Intellectuals, Kasim Trnka, points out that on the unconstitutional Day of RS, they want to show that the formation of the so-called Serb Republic of BiH in January 1992 was also unconstitutional. This policy continued under Slobodan Milosevic and later Alexander Vucic, but it culminated with the All-Serb Assembly in 2024.
“All the time, especially in connection with the All-Serb Assembly, they invoke the constitutional institute according to which entities have the right to establish parallel relations with neighboring states. That is true, but they go far beyond that and abuse that institute of special parallel relations,” he told journalists.
From yesterday’s gathering, the Council of the Congress of Bosniak Intellectuals calls on all political actors who participate in power at the state level to consider “such moves from the RS entity and to take appropriate measures.”
“It is a special duty and responsibility of the constitutionally envisaged authorized proposers to request constitutional-judicial review, not only of these regulations, but also of parts of the Declaration by which an attack on the constitutional order of BiH is carried out. This issue, which is important for the further development of the constitutional order of BiH, as well as for bilateral relations with Serbia, should be addressed more by scientific and professional institutions as well as by competent individuals,” it was emphasized at the gathering, Federalna writes.
