Becirovic Requests Constitutional Court Review of RS National Assembly Conclusions

Member of the Presidency of Bosnia and Herzegovina Denis Bećirović today submitted a request to the Constitutional Court of BiH for the assessment of the constitutionality of the conclusions of the National Assembly of Republika Srpska (NARS) regarding information regarding the decision of the Central Election Commission of BiH on the termination of the mandate of the President of Republika Srpska Milorad Dodik, Bećirović’s office announced.

Bećirović requests that the Constitutional Court of BiH determine, in accordance with the Constitution of BiH and previous practice, that the entity of Republika Srpska does not have constitutional jurisdiction to adopt the disputed conclusions and, in accordance with Article 61, paragraphs 1, 2 and 3 of the Rules of the Constitutional Court of BiH, annul and invalidate these conclusions.

In the explanation of the request, he points out that the adopted conclusions of the National Assembly of Republika Srpska of August 22, 2025 violate the Constitution of Bosnia and Herzegovina, its laws, numerous international agreements and do not respect the final judgments of the courts of BiH.

It also indicates that the conclusions unconstitutionally order institutions, legal entities and individuals in the entity of Republika Srpska to continue adopting unconstitutional acts and other unconstitutional and illegal activities.

The National Assembly of Republika Srpska does not have the right to reject final judgments and decisions of the Court of BiH, the Central Election Commission of BiH, the Constitutional Court of BiH and the High Representative in BiH. Failure to comply with final judgments and decisions of the competent authorities is a flagrant violation of the Constitution of BiH and the General Framework Agreement for Peace in Bosnia and Herzegovina, as well as the Criminal Code of BiH, states Bećirović.

In accordance with his constitutional powers, in this and all other cases of unconstitutional conduct, he will continue to act concretely with all available legal and political means with the aim of respecting and implementing the principles of constitutionality and legality, the statement said.
