Representative in the Parliament of the Federation of Bosnia and Herzegovina (FBiH) Irfan Cengic presented yesterday the Decision on amending the Rules of Procedure of the House of Representatives of the Parliament of the FBiH, which he claims that its adoption would ensure the implementation of the election results in the FBiH and prevent all blockades in the FBiH.
The essence of the proposed changes is that, in accordance with the Constitution of the FBiH, it is possible for a third of each caucus of delegates of the constituent nations to independently propose a joint list of candidates for the president and two vice-presidents of the FBiH, and not, as was the practice until now, that at least a third of all three caucuses must jointly propose a list of candidates.
Cengic believes that the existing provisions of the Rules of Procedure of the House of Representatives of the Parliament of the FBiH, which refer to the election of the president and two vice-presidents of the FBiH, are not in accordance with the Constitution of the FBiH.
Namely, in the Constitution of the FBiH, Part B – EXECUTIVE AUTHORITY OF THE FEDERATION, Chapter 1. President and Vice-President of the Federation, Article 2, Paragraph (1) it is stated: “In the election of the president and two vice-presidents of the FBiH, at least a third of the delegates from the caucuses of Bosniak, Croat or Serbian delegates in the House of Peoples can run for the president and two vice-presidents of the FBiH.”
Cengic points out that the Rules of Procedure of the House of Representatives of the FBiH Parliament are contrary to the FBiH Constitution, because instead of the conjunction “or” in the text of the Rules of Procedure, the conjunction “and” was inserted in the text of the Rules of Procedure, and thus, in essence, the prescribed procedure is completely contrary to the FBiH Constitution.
”Although it looks like an insignificant typographical error, it is a gross violation of the FBiH Constitution, which is clearly given the authority by this article for a third of each people’s caucus to individually propose a joint list of candidates for the president and vice president of the FBiH, which is later declared by the entire houses, both the House of Representatives and the House of Peoples. In the Rules of Procedure of the House of Peoples of the FBiH Parliament, it is clearly stipulated that the election is carried out in accordance with the FBiH Constitution,” Cengic stated, Federalna writes.
