Court of BiH confirmed Indictment against Mehmed Dobraca for War Crimes

On 25 June 2019, the Court of Bosnia and Herzegovina confirmed Indictment against the accused Mehmed Dobrača for the criminal offenses of War Crimes against Civilians under Article 173(1)(c) of the Criminal Code of BiH Bosnia and Herzegovina (CC BiH) and War Crimes against Prisoners of War under Article 175(1)(a) of the CC BiH, as read with Article 180(1) thereof.

According to the Indictment, during the war in Bosnia and Herzegovina (BiH) and the armed conflict between the Army of BiH and the Army of the Republika Srpska, in the territory of Rogatica and Goražde municipalities, in the time period from the beginning of June 1995 until the end of 1995, the accused Mehmed Dobrača, in his capacity as clerical officer for staff-security and military-police affairs with the security organ of the 81st Division of the Army of BiH from the beginning of February 1995 until the second half of October 1995 and Assistant Commander for Security of the 81st Division of the Army of BiH from the second half of October 1995 until the end of 1995, acted in violation of rules of international humanitarian law and breached the provisions of common Article 3(1)(a) of the Third Geneva Convention relative to the Treatment of Prisoners of War and the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12 August 1949 and Articles 86 and 87 of Protocol I, by depriving persons of liberty and committing other inhumane acts of a similar character with the intent to cause great suffering or serious injury to body or to physical or mental health.
