Having deliberated on an appeal filed by the Prosecutor’s Office of Bosnia and Herzegovina (BiH) against a Decision of the Court of BiH in the case of Sena Hamzabegovic dated 13 May 2021 dismissing a motion to order the suspect into pre-trial custody, the Court of BiH issued a Decision on 17 May 2021 granting the appeal by Prosecutor’s Office of BiH and reversing the first-instance decision by ordering suspect Sena Hamzabegovic into pre-trial custody.
Under this decision, pre-trial custody may not exceed a period of one month after the date of deprivation of liberty, i.e. until 17 June 2021.
The pre-trial custody was ordered on the grounds of a risk of flight and due to particular circumstances justifying a fear that the person will repeat the criminal offense or complete the criminal offense punishable by imprisonment for a term of five years or by a heavier penalty.
Sena Hamzabegovic is suspect of committing the criminal offense of Funding of Terrorist Activities in violation of Article 202 Paragraph 2(a) and (c), as read with Paragraph 1 of the Criminal Code of BiH.
