Decision on the Appointment of Šahbaz Džihanović as a Judge

sahbazThe FBiH Constitutional Court Council for protection of vital national interest determined that the proposal by former President of FBiH Živko Budimir on the appointment of Šahbaz Džihanović as a judge of the FBiH Constitutional Court did not violate the national interest of the constituent Bosniak people.

This is the epilogue of the proceedings before this Panel launched by the caucus of the Bosniak people, i.e. the majority of the Bosniak deputies from the previous convocation of the House of Peoples of the FBiH Parliament.

The applicants in their request for determining the existence of vital national interest of the Bosniak people stated that the appointment of Džihanović was contrary to Bosniak national interest, and cited “that Džihanović illegally awarded BiH citizenship to the growing number of foreigners in the period from 1 March 2006 to 31 January 2007, in the time when he served as Consul General of BiH in Germany”.

In the opinion related to the verdict the President of the Constitutional Court of the Federation of BiH Kata Senjak said that the Council after examining the report of the State Committee for Audit of Decisions on Naturalization of Foreign Citizens in BiH found that this report cannot be the basis for the evaluation of any candidate for the position of a judge of the Constitutional Court of FBiH.

The Council for protection of vital national interest of the FBiH Constitutional Court issued another judgment which established that the Draft Law on apartments lease does not go against the vital national interests of the Croat people.

The third judgment decision rendered by the Council for the protection of vital national interest today refers to the request of the Croat caucus in the Assembly of the Central Bosnia Canton for determining the existence of vital national interest for the Croat people in the process of giving opinion on the Draft of the Spatial Plan of the Federation of Bosnia and Herzegovina until 2028.

This judgment confirmed the violation of the national interest of the Croat people.
