Did the Prosecutor’s Office abuse the Decision of the Constitutional Court on the Dobrovoljacka Case?

The Association of Generals of Bosnia and Herzegovina (BiH) sent an open letter regarding the confirmation of the indictment for the events in Dobrovoljacka Street in Sarajevo in May 1992.

”On May 12th, we were informed by the media that the indictment was confirmed, which further raises suspicions that there is political pressure in this case, which is why we insist again that, before the indictment enters into force, all attached evidence be reviewed in detail, as well as all decisions that preceded it, primarily the decisions of the International Criminal Tribunal for the Former Yugoslavia (ICTY) and the Prosecutor’s Office of BiH from 2012, according to which there was no evidence for indictments. Is it possible that the judge who confirmed the indictment managed to review 500 pieces of evidence and 277 testimonies attached to the indictment in just a few days, or to determine what the new evidence is, and why is someone in such a hurry after 20 years?” is stated in the letter.

After that, the Association reminded of the requests they made at the press conference, which were sent to the Court and the Prosecutor’s Office of BiH, as well as the High Judicial and Prosecutorial Council (HJPC) of BiH in connection with the case of Dobrovoljacka, and to keep in mind:

After the indictment was filed in the Dobrovoljacka case, the Association of Generals asked for answers to the following questions.

On the basis of which was the investigation of Dobrovoljacka re-launched after all these decisions, especially after the decision of the Prosecutor’s Office of BiH from 2012?

What “new evidence” emerged after 30 years and was the Hague tribunal right in finding it to be a politically motivated case? The 377-page file of the Hague Prosecutor’s Office, in which it believes that there is no criminal responsibility for individuals who were today in the indictment of the Prosecutor’s Office of BiH with all explanations and names, is in the Prosecutor’s Office of BiH.
