Disciplinary Complaint Against Prosecutor Kajganic Dismissed

The Office of the Disciplinary Prosecutor dismissed the complaint against the Chief Prosecutor of Bosnia and Herzegovina (BiH), Milanko Kajganic, due to a lack of evidence, regarding his appearance on a television program in which he commented on the prosecution of genocide denial.

The Office of the Disciplinary Prosecutor of the High Judicial and Prosecutorial Council (HJPC) of BiH said that the complaint, which was registered ex officio in connection with Kajganic’s appearance on a television program on April 13th, 2023, was dismissed after an investigation was conducted “because there is no evidence of a disciplinary offense committed.”

After the Chief Prosecutor’s appearance, the Office of the Disciplinary Prosecutor formed a case against him within just a few days, and BiH media reported last month that the Office had still not made a prosecutorial decision, even though nearly two years had passed.

During his appearance on the television program, Kajganic stated, among other things, that “the public now believes that a new law has been passed, that this law prohibits only the denial of genocide, and that any debate about whether or not genocide occurred somewhere constitutes a criminal offense,” and added that this is not in accordance with the Criminal Code of BiH.

At the time, Kajganic said that he had not been officially or unofficially informed of a case being opened against him and that he had no intention of commenting on the decisions of the Office.
